Tom Smith, BDO, Partner: 

Tom’s career began as an auditor for the Texas Comptroller of Public Accounts. There, he spent over six years performing out of state audits. He frequently conducted training classes and performed numerous computerized samples. He was also called upon to testify as an expert witness, on several occasions. This foundation with the state gave him special insight as his career moved into public accounting. Tom spent a total of 15 years at several Big Four firms before joining a local firm in Oklahoma in 2010.

Tom is known for his expertise in tax controversy, and has also recovered millions for his clients through reverse audits. He has had vast experience managing taxability research projects and regularly works on due diligence projects both pre and post-acquisition. Tom is well known in Nashville Tennessee, where he developed a significant expertise in the healthcare industry. He also has extensive experience in the energy industry as well, servicing clients in both Oklahoma and Texas.

Tom is a frequent speaker on the topic of state taxation for Lorman Seminars, LAT Seminars, the OSCPA, and Council of Petroleum Accountants Societies. Tom also speaks at many CPA firms nationally, as a subject matter expert for their year-end update events.

Tom recently joined BDO as the partner in charge of the Southwest State and Local Tax practice. Although he calls Tulsa home, he leads a team of over 40 professionals in Tulsa, Dallas, Houston, and Fort Worth.

 

Viriam Vazquez, BDO, CMI Senior Manager, Sales and Use Tax-

Viriam Vazquez is a Senior Manager within BDO’s Southwest State and Local Tax practice. Prior to joining BDO in 2014, Viriam spent over four years with the Texas Comptroller of Public Accounts. She also spent time in Big 4, as well as with BDO’s Risk Advisory Services practice. Viriam is bilingual in Spanish and has served several of the firm’s international clients. 

As a former auditor for the state of Texas, Viriam has extensive experience with Texas sales & use tax and has developed a strong network of contacts within the Texas Comptroller’s Office. Her sales & use tax experience includes analysis of purchase and sales data; preparation and review of tax reconciliations; sample generation and evaluation; taxability research; reverse audits; audit defense and settlement negotiations of audits and refunds for taxpayers. As a BDO project lead, she has gained extensive experience with a variety of industries including healthcare, manufacturing, construction, service and entertainment providers, and retailers and wholesalers.

DESCRIPTION:  In this session we will discuss aspects of Sales and use tax audits.

LEARNING OBJECTIVES:

By the end of the class you should be able to:

1) Know how to handle a sales or use tax audit, from the arrival of the audit notice to the post-audit review. 

2) Learn about best practices in defending an audit, including how to address statute of limitations waiver requests

3) Understanding audit sampling and some benefits and burdens.

4) Learn how to analyse audit assessments and related workpapers.

5) Understand options after an audit is complete, including protest and refund options.
